Dear Candidate, We present our privacy policy – the data protection provisions adopted by Orienta Polska Sp. z o. o. (hereinafter referred to as the Company), which are necessary to protect your personal data in accordance with the law. 
The following information will help you understand: 

  • which entities process your data and how to contact them; 
  • how and why the data is analysed; 

Orienta Polska Sp. z o. o. undertakes to protect the personal data entrusted to it. Consequently, data management and security are guaranteed with the utmost care, in accordance with the requirements of the currently applicable privacy protection legislation, and in particular EU Regulation 2016/679 (GDPR).

 

Data controller and data protection office

Orienta Polska Sp. z o. o. is the company that processes your data and is considered the data controller for legal purposes. In this capacity, it is responsible for ensuring the necessary and appropriate organisational and technical measures to protect your data. The Company’s registered office is located in Warsaw (00-845) at ul. Łucka 18, flat 7.

In addition, the Company has appointed a Data Protection Officer responsible for ensuring compliance with privacy regulations, who can be contacted regarding any questions relating to the processing of your data at the following address: Warsaw (00-845, ul. Purpose of data processing

Please be advised that all personal data you provide will be processed in accordance with the applicable data protection regulations; therefore, the Company undertakes to process such data in accordance with the principles of fairness, lawfulness and transparency, and in accordance with the purposes set out below, collecting data only to the extent strictly necessary for processing; The data will be used exclusively by staff for lawful purposes and in a lawful manner, and to ensure the necessary confidentiality of the information provided. 

The Company may use the data in particular for:

  1. Purposes relating to pre-contractual activities, the management of the contractual relationship/relationship arising from training, and the provision of services. 

Your personal data will be processed for the purpose of: selecting and recruiting staff with a view to establishing a potential employment relationship, through registration in the Orienta database, including for positions unrelated to those for which you applied on your own initiative; in addition, based on your registration in the database, we will also periodically send you job vacancies by email that may be of interest to you; updating job vacancies matching your profile/Job Alert; managing applications in response to job vacancies published on our website; for purposes related to the establishment, management and termination of the contractual relationship and that arising from training (e.g. compliance with obligations regarding accounting, payroll, insurance, healthcare and tax); the administration of specific leave, absences and benefits related to the management of the employment relationship; compliance with legal and regulatory obligations (e.g. preventive medicine, occupational health, anti-terrorism checks, etc.); managing any legal disputes; providing, supporting, updating and informing about the services and features available from Orienta Group companies; activating online services (e.g. access to the private area at www.orientapolska.pl, attendance registration); where necessary, the activation of the remote digital signature service; consultancy, career management advice (including career development and job changes) and relocation.

The processing of the above data is mandatory in order to provide the service required of us; therefore, your refusal will prevent us from entering into a contractual relationship.

The processing of personal data for the aforementioned purposes may take place via a web application or a smartphone app.

The company may use automated systems/processes and decision-making procedures, which are not entirely automated, to provide you and our clients with the required services. For example, if our clients are seeking candidates for specific roles, we may search our candidate databases using automated criteria that take into account availability, overall skills acquired, salary level, and in some cases feedback previously received from clients, to draw up a list of candidates that will include those most likely to meet the client’s requirements. 
Your data may be used, in particular, to process results based on a scoring system derived from the information you have provided in your CV. In this regard,  you may receive job offers that are as closely matched as possible to your experience and skills.
 

  1. Purposes related to the recording and processing of images.

Images, photographs, audio and video recordings that you have voluntarily sent to us will be processed, in particular, for the following purposes: to send recordings and interview footage to clients and/or parties potentially interested in your application; processing offers and promotions of resources (e.g. candidates, employees) aimed at existing and potential clients, as well as companies within the Orienta Group. 

Furthermore, the Company may only use your data for the following purposes with your voluntary, specific, informed and unambiguous consent: 
 

  1. Purposes related to marketing activities.

In particular for: market research, economic and statistical analyses; social, cultural and solidarity initiatives; commercial information; marketing; sending advertising/informational/promotional materials and updates on initiatives, promotions and offers from third-party companies cooperating with Orienta Polska Sp. z o. o. and specifically appointed as external data processors, including in relation to programmes and promotions, including online, aimed at rewarding or recruiting permanent candidates and employees; communication and information regarding the Group’s activities and events in which Group companies participate.

Data processing in this section is not mandatory for the performance of the contract, and consent is voluntary; therefore, your refusal does not prevent the establishment of an employment relationship.
 

Notifications for the following purposes may be sent by traditional means (e.g. post, telephone), automated means and similar methods (e.g. fax, email, SMS, app, etc.).

The scope and relevance of the data provided will be periodically assessed to determine further decisions and to avoid processing data beyond the intended purposes.

We will not use your personal data for purposes other than those described in this information leaflet without first informing you and, where necessary, obtaining your consent.

 

Use of special category personal data

If you decide to apply for a specific position and/or provide us with special category personal data, Orienta Polska Sp. z o. o. will need to process and collect data for which your consent is required by law. In some cases, such data may be strictly necessary for selection purposes. In such cases, we inform you that it will be processed solely for “purposes related to the management of the contractual relationship/training and the provision of services”.

 

Security measure

Orienta Polska Sp. z o.o. is committed to protecting the personal data provided to us, in accordance with the principles of fairness, lawfulness and transparency. We therefore inform you that your data will be processed using tools and procedures that ensure maximum security and confidentiality, through the use of archives and paper-based forms, as well as digital, computerised and telematic media. Notifications may be sent by traditional means (e.g. post, telephone), automated means and similar methods (e.g. fax, email, SMS, app, etc.).

 

Data retention period and deletio

Your personal data will be stored from the date of receipt/last update/last access to your profile for a maximum period of seventy-six months for the purpose of managing your application (unless otherwise required by law, which may stipulate longer periods), after which it will be permanently deleted or anonymised. In addition, the Company has provided for the option to personally/independently delete your profile on the website. 

However, if an employment relationship is established with you, your personal data will be stored from the date of receipt for a period consistent with the processing purposes indicated above, in accordance with applicable regulations and the Company’s legitimate interests, after which it will be deleted or anonymised. 
The Company, including through periodic checks, will regularly verify the strict relevance, non-excessiveness and necessity of the data stored in connection with the relationship, the performance or termination of the contract/legal relationship, including in relation to data that the data subject provides on their own initiative. 
The storage of the aforementioned data is provided for in the new EU Regulation No 679 of 2016 and, therefore, your consent is not required.
The Company will store your data in particular for the following purposes:

  • to pursue or defend any rights in judicial, administrative, arbitration or conciliation proceedings, in cases provided for by law, European Union legislation, regulations or collective agreements;
  • to fulfil any tax and administrative obligations.

 

Data transfer and access

For “purposes related to the management of the contractual relationship/training-related relationship and the provision of services” and for “purposes related to the recording and processing of images”, your data may be shared with relevant companies solely to enable them to verify whether your profile is fully compatible with the position they are seeking to fill. Furthermore, we inform you that your data may be transferred to companies belonging to the Orienta Group and to third parties (including client companies, partner companies, specialists, public authorities, control bodies or supervisory authorities) in order to fulfil obligations arising from laws, regulations, EU regulations or provisions relating to the management and performance of the contract.

For marketing purposes, data may be transferred to companies belonging to the Orienta Group, public authorities or third parties working in cooperation with Orienta Polska Sp. z o. o. 

For all the purposes set out in this privacy policy, publicly available personal data may also be transferred abroad, both within and outside the European Union, in accordance with the rights and safeguards provided for by applicable legislation, subject to prior verification that the country in question guarantees an ‘adequate’ level of protection.

Data will also be processed using internal resources at the offices of appropriately trained Group companies, which act as authorised data processors.

The Company ensures that your personal data will not be transferred to a third party without your consent. 

 

Your rights

With regard to the data being processed, the Company guarantees you the right to:

  • obtain confirmation as to whether or not your personal data is being processed, and to receive a copy of such data in a legible form;
  • update, rectify or complete your data;
  • request the erasure of your personal data under the conditions provided for by law, or request that it be anonymised;
  • object, in whole or in part and on legitimate grounds, to the processing of personal data concerning you;
  • restrict processing in the event of a breach, a request for rectification or an objection;
  • request the portability of electronically processed data provided on the basis of consent or a contract;
  • withdraw consent to the processing of your data at any time, if a request has been made.
     

To this end, the Company has provided the following options on its website:

  • automatic deletion of your profile if no contractual relationship has ever been established;
  • if an employment relationship has been established, you may submit a request for data deletion by email to: [email protected]. Alternatively, you may visit one of the company’s offices or send your request by registered post.

Please be advised that the Company is required to respond to your requests within one month, except in particularly complex cases, where this may take up to three months. In any event, the Company will explain the reason for the delay within one month of receiving your request.

The outcome of the request will be sent in writing or electronically. If you request rectification, erasure or restriction of data processing, the Company undertakes to communicate the outcome of the request to each recipient of your data, unless this is impossible or would involve a disproportionate effort.

Please note that the withdrawal of consent does not affect the lawfulness of processing based on consent prior to withdrawal.
The Company states that a fee may be charged if your requests are manifestly unfounded, excessive or repetitive; to this end, the Company has established a register to track your requests for intervention.

 

If it is established that the Controller’s processing of personal data infringes the provisions of the GDPR, you have the right to lodge a complaint with the supervisory authority, which since 25 May 2018 has been the President of the Personal Data Protection Office;
